Is there a warranty on items sold on Agorastore?

1. The principle: an item sold as is

Items listed on Agorastore are generally sold without a commercial warranty. This means you buy the item in its current condition, including any visible or hidden defects.

Agorastore connects buyers and sellers, but does not take part in concluding the sale itself: this happens directly between you and the seller.

2. Legal warranties depending on the type of sale

The legal framework differs depending on how the sale is carried out:

Standard brokered sale

The legal warranties of conformity and against hidden defects apply under ordinary law.

Sale awarded by our auctioneer

The legal warranty against hidden defects is excluded, within the limits allowed by law. This is also one of the exclusion cases for this type of sale provided for in the Complaint Policy.

This distinction explains why some sales cannot be the subject of any complaint for non-conformity: this is notably the case for sales awarded by our auctioneer.

3. The right of withdrawal

If you buy as a consumer as part of a standard brokered sale, you benefit from a 14-day right of withdrawal, starting from the first day of the collection period.

This right does not apply to sales concluded through auction by our auctioneer, in accordance with the legal regime governing public auctions.

Frequently asked questions

Can I get a refund if the item doesn't suit me?

It depends on the type of sale. For a standard brokered sale, a consumer can exercise their right of withdrawal within 14 days of the start of the collection period. For a sale awarded by our auctioneer, this right does not apply: only a proven non-conformity can be reviewed.

Does the warranty against hidden defects apply to all items?

No. It is excluded, within the limits allowed by law, for sales awarded by our auctioneer. For other sales, the legal warranties of conformity and against hidden defects apply under ordinary law.
